MINUTES OF THE PUBLIC MEETING OF JUNE 22nd , 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:35 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Public Hearings

7:45 PM  Notice of Intent for construction of a single family house, subsurface sewage disposal system, access driveway, utilities and grading at Lot 5, Ransom Road, Assessor's Map 63, Lot 1 for applicant Michael Casey, 24 Meadow Lane, Hanson represented by Land Planning, Inc., 1115 Main St., Hanson, MA.  (DEP #175-432)  (New Hearing)

Amy read the Public Hearing Notice and the green cards were checked.  Bernie Munro of Land Planning, Inc. attended along with Mr. & Mrs. Michael Casey.  Mr. Munro presented a proposal showing the configuration of the location of the house.  Ms. Cassady brought up the issue of an Enforcement Order on the property.  The trees on the lot were clear-cut to the Bordering Vegetated Wetland and debris was stockpiled in the wetlands.  She would like to see a restoration project in the proposal to compensate for the damage.  She suggested that the Casey’s hire a botanist.  She also recommended a site walk with the Commission.  Mr. Lindquist read the abutters list.  None were present.

Motion to continue the NOI and EO pending a site visit and submittal of a restoration plan to July 13th at 8:45 PM:  Amy Gardner

8:30 PM  Notice of Intent for construction of access drive, utilities, buildings and related grading partially within the 100-foot buffer zone at 255 rear Liberty St., Assessor's Map 82, Plot 6-1 for Dennis Leary, 2 Columbia Rd., Pembroke, MA represented by Keefe Assoc., Hudson Park Realty Assoc. RT, 2 Columbia Rd., Pembroke, MA  02359.  (DEP #175-)  (New Hearing)

Amy read the Public Hearing Notice and the green cards were checked.  John Keefe and John Burns attended representing Dennis Leary.  The proposal calls for two, 4-unit condominiums served by a driveway that goes through the 50-foot no disturb zone.  Mr. Keefe suggested a mitigation plan for the disturbance created by the construction of the driveway.  Ms. Cassady requested that they submit a variance letter to work in the buffer zone as well as payment of the by-law fee.  A Mr. Peter Guidaboni of 255 Liberty Street, an abutter introduced himself and informed the board that since the trees had been cut and a road was pushed through, his backyard and basement had flooded whereas he never had water before.  Ms. Cassady read into the record that Richard Oberstein and Kathleen Murphy of 269 Liberty St. approved the project, but couldn’t come to the hearing.  Mr. Lindquist read off the abutters list.  No others were present.  Mr. Guidaboni commented that the roadway is blocking drainage for his property and he would like to see some provisions for flooding.  He gave permission to go onto his property.

9:00 PM  Request for Determination of Applicability for the proposed reconstruction of Franklin Street from the Whitman town line to the Hanson town line, approx. 2,052. Ft.  Additionally, a portion of Oak St. (Rt.14) and W. Washington St. (also Rt.14) will be included in the project.  The applicant is the Massachusetts Highway Department, 10 Park Plaza, Boston, MA 02116-3973   (New Hearing)

Amy Gardner read the Public Hearing Notice.  This meeting was advertised in the Hanson Express on June 17, 2004.  Senior Project Manager, Eric Carlson of Guertin Elkerton & Associates, Inc., Engineers attended the meeting and presented the proposal for the reconstruction project.  Their firm was hired by the Town of East Bridgewater and they are responsible for acquiring the necessary permitting from the different towns that are included in the project.  The proposal calls  for a full-depth reconstruction, roadway pavement that includes widening, a sidewalk on Franklin St. and lights at the intersection of Routes 14 & 27.  Three wetland areas were identified and provisions (haybales and silt fence) have been proposed to protect them.  Mr. Grattan asked for the time frame of the project.  Mr. Carlson thought possibly 12-18 months.

9:30 PM Notice of Intent for the proposed construction of a detached garage on a single-family lot within 100 feet of a BVW at 288 County Rd., Assessor's Map 74, Lot 4-02 for owner Jim Young represented by Grady Consulting, LLC, P.O. Box 308, Kingston, MA  02364.  (DEP #175-)  (New Hearing)

Amy Gardner read the Public Hearing Notice and the green cards were checked.  Rick Grady representing Jim Young made the proposal.  The plan calls for a garage on a slab foundation.  Haybales are proposed.  Three or four trees have to come down.  Mr. Lindquist read the abutters list.  None were present.

Appointments

8:00 PM  Appointment with Mark Modestino to discuss an in-ground pool.  Would require an Amended Order or a new Notice of Intent.  (DEP #175-397)  

Mr. Modestino presented a plan for an in-ground pool that is in the 50-foot no disturb zone and a 200-foot riparian zone (riverfront area).  Ms. Gardner made the suggestion that Mr. Modestino hire an engineer to change the location of the pool and file an Amended Order of Conditions.  

 8:45 PM  Appointment with James & Rita Gomes, abutters to James Arena of 131 Whitman Street  (DEP #175-417) to discuss driveway issues.  (See minutes of June 8, 2004)

Mr. & Mrs. Gomes, abutters to James Arena, voiced their disappointment at the proximity of Mr. Arena’s driveway to their house.  Ms. Cassady asked the Gomes if they had had their property surveyed.  They had and the lines were correct.  Ms. Cassady then brought out the plans and explained how Mr. Arena had filed all the necessary paperwork and held a public hearing.   It had been approved and an Order of Conditions issued.  Although the Board sympathized with the Gomes,  it had been due process.  Mr. Arena was very amenable to planting trees along the driveway to create a barrier for his neighbors.  Mr. Grattan suggested Arborvatae as they are fast growing.

9:15 PM  Appointment with Roy Vinton to discuss a violation notice for Colonial Heights

Mr. Lindquist read the Violation Notice.  Mr. Vinton appeared before the Commission to explain the progress he is making on Valley Forge Road, which is off of Independence Way.  Apparently, the catch basin was clogged previously and that is why they had street flooding. He has hired SITEC to draw up new drainage plans and correct the problem.  A site visit was scheduled for Sunday, June 27th at 10AM.

Discussions

Agent Tricia Cassady, much to the dismay of the Board of Commissioners, gave her resignation with notice.  She would like to devote more time to her consulting business.  The Board thanked her for her expertise and service to the Town of Hanson and reluctantly accepted her resignation.
